GENERAL TERMS AND CONDITIONS

 

1. COMPANY INFORMATION

 

These General Terms & Conditions apply to all memberships, online courses, digital products, and services offered by:

2. DEFINITIONS

 

EquiHaven / We / Us: The business entity providing the Services and digital content under these General Terms and Conditions.

 

Services: All digital content and services, including but not limited to memberships, online courses, videos, blogs, PDFs, instructional materials, and community features offered through EquiHaven’s platform.

 

User/You: Any individual or entity that purchases, accesses or subscribes to EquiHaven’s Services.

 

Parties: EquiHaven and User together

 

Account: A personal, non-transferable user profile created upon membership or course purchase/registration, granting access to EquiHaven’s content. 

 

Membership: A paid subscription plan that grants Users access to specific EquiHaven Services for a specified or recurring duration. 

 

Course: A standalone digital educational product delivered online, including but not limited to the Show Prep Course - Everything You Need to Get Show‑Ready and the Plaiting Course - A Step‑By‑Step Guide, and any future courses.

 

Digital Content: Any non-physical instructional material, video, blog post, or other media available through EquiHaven’s platform.

Force Majeure: Unforeseen events beyond EquiHaven’s control that may disrupt the Services, including but not limited to natural disasters, technical failures, or government-imposed restrictions. 

 

Intellectual Property: All proprietary content, including courses, videos, blogs, PDFs, and other materials, owned or licensed by EquiHaven, protected under copyright and other applicable laws. 

 

 

3. APPLICABILITY

 

  1. These terms and conditions will apply to all quotations, offers, purchases, activities, orders, agreements and deliveries of services or products by or on behalf of EquiHaven. 

  2. By purchasing a Course, subscribing to a Membership, or using the Services, you confirm that you have read and accepted these Terms.

  3. Parties can only deviate from these conditions if they have explicitly agreed upon in writing.

  4. The Parties expressly exclude the applicability of supplementary and/or deviating general terms and conditions of the customer or of third parties.

 

 

4. SERVICES AND LICENSE

 

EquiHaven grants you a personal, non-exclusive, non-transferable, revocable license to use its Services, including digital content (subject to payment, where applicable), strictly for personal use and in accordance with these Terms. All rights not expressly granted are reserved. EquiHaven reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. Reasonable efforts will be made to inform users of material changes. We are not liable for any modifications, interruptions, or terminations of the Services. EquiHaven is not obligated to retain any user data or content beyond the period required by applicable law.

 

If any provision in these Terms is deemed void or unenforceable by a court, the remaining provisions shall remain in effect. The void provision will be replaced by a valid provision that reflects its intent as closely as possible.

 

 

5. ACCOUNT USE

 

Upon purchasing a membership, an account will be created for you, and EquiHaven will provide personal login details. Your account is strictly personal and must not be shared. If you suspect unauthorised access, you must notify EquiHaven immediately.

 

EquiHaven reserves the right to block an account in case of violations of these Terms. If you wish to close your account, you can do so via "My Account" or by sending an email with the request. Any content submitted through your account will remain available on the platform, but personally identifiable data will be removed upon request, in accordance with legal requirements.

 

Accounts inactive for more than 12 months may be deleted after prior notification via the registered email address. Account closure is irreversible, and any purchased content will no longer be accessible after deletion.

 

 

6. PRICES AND PAYMENT

 

Memberships grant access to specific content for a specified period. By subscribing, you authorise EquiHaven to charge the provided payment method on a recurring basis, depending on the selected plan. Annual Memberships automatically renew after one year unless cancelled before the renewal date.

 

Course prices apply at the time of purchase and do not affect completed transactions.

 

All prices are in euros, inclusive of VAT and applicable government levies, unless stated otherwise. Payment must be completed before access is granted and accepted payment methods are shown at checkout. EquiHaven is entitled to adjust all prices for its products or services, shown on its website or otherwise, at any time. The parties agree on a total price for a service provided by EquiHaven. This is always a target price, unless the parties have explicitly agreed upon in writing on a fixed price, which cannot be deviated from.

 

EquiHaven has the right to adjust prices annually. EquiHaven will communicate price adjustments to the customer prior to the moment the price increase becomes effective. The consumer has the right to terminate the contract with EquiHaven if they do not agree with the price increase. 

 

Digital content is accessible for streaming only within the account and cannot be downloaded. Downloading or attempting to download content is strictly prohibited, except for PDF materials explicitly provided for download.

 

 

7. ACCESS & DELIVERY

All Services are delivered digitally.

  • Courses: Access is granted immediately after payment for the duration stated on the sales page or for a reasonable period.

  • Memberships: Access is provided for the active subscription period.

You are responsible for ensuring suitable devices and internet access.

 

 

8. RIGHT OF WITHDRAWEL (COOLING-OFF PERIOD)

 

Under 2EU consumer law, consumers normally have a 14‑day right of withdrawal for distance purchases.

By purchasing a Course or Membership and selecting immediate access, you:

  • expressly consent to immediate delivery of digital content, and

  • acknowledge that you waive your statutory 14‑day right of withdrawal once access begins.

By purchasing a Course or Membership, you agree to these terms and consent to immediate access, thereby waiving your 14-day right of withdrawal.

 

 

9. CONSEQUENCES OF NON-PAYMENT

 

Failure to complete payment for your membership will result in the following actions: 

 

Access Restriction: Your account and all associated Services will be temporarily suspended until full payment is received. 

 

Automatic Retry: EquiHaven may attempt to process the payment again within a reasonable period. You will be notified via email before any further attempt. 

 

Account Termination: If payment remains outstanding after repeated attempts, EquiHaven reserves the right to terminate your account and revoke access to all content without further notice.

 

Debt Collection: In cases of prolonged non-payment, EquiHaven may engage third-party collection agencies or take legal action to recover outstanding fees. Any additional costs incurred for recovery efforts will be added to the outstanding amount.

 

Reinstatement: If your account is suspended due to non-payment, you may reinstate access by settling all due amounts. However, EquiHaven is not responsible for lost access or content availability during the suspension period. 

 

 

10. REFUNDS AND CANCELLATION

 

Courses

All Course purchases are final and non‑refundable once access has been granted, unless required by law.

Memberships

You may cancel a Membership at any time via your Account. Cancellation prevents future billing but does not entitle you to a refund for the current billing period, unless legally required.

11. USER CONTENT

 

By submitting content through our Services, (including comments or contributions to community discussions), you grant EquiHaven a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, display, modify, and distribute your content in any format for service improvement and promotional purposes.

12. RULES OF USE

 

Use of EquiHaven's Services must comply with Dutch and other applicable laws. The following actions are strictly prohibited:

 

  • Sharing defamatory, libelous, or racist content.

  • Uploading or sharing content that infringes intellectual property rights.

  • Violating privacy rights, including sharing personal data without authorisation.

  • Sharing account access with third parties.

  • Attempting to download or copy video content, blogs, or other digital materials, except for PDFs explicitly provided for download.

  • Sharing, distributing, or reproducing any content from the membership area, including videos, blogs, PDFs, and other exclusive materials, in any manner without explicit permission.

  • Posting reviews under false identities or in an inappropriate language.

 

Violations may result in account suspension or termination without compensation. EquiHaven reserves the right to take necessary action to prevent misuse, including blocking accounts, removing content, and seeking damages from the responsible party.

13. INTELLECTUAL PROPERTY

 

All instructional Digital Content materials, video content, blogs, PDFs, and other information within the membership area remain the intellectual property of EquiHaven or its licensors. These materials may not be copied, shared, downloaded (except for explicitly provided PDFs), or used in any manner without explicit written permission.

 

By submitting feedback or suggestions to EquiHaven, you grant us an unlimited right to use such information for service improvements.

14. LIABILITY

EquiHaven provides educational content only and makes no guarantees regarding results.

EquiHaven is not liable for indirect or consequential damages, loss of income, or technical disruptions beyond reasonable control.

Liability is limited to the amount paid for the relevant Service, unless liability cannot be limited by law.

 

15. FORCE MAJEURE

 

EquiHaven is not liable for failure to fulfil obligations due to force majeure, including but not limited to power failures, network disruptions, strikes, natural disasters, and supplier failures. If a force majeure event lasts longer than 90 days, either party may terminate the agreement without liability.

 

 

16. AMENDMENTS TO TERMS

 

EquiHaven reserves the right to modify these Terms. Users will be notified at least 30 days in advance of any significant changes. If you do not agree to the modifications, you may object within 14 days of notification. If we uphold the changes, you may terminate your membership before the changes take effect. No refunds will be issued for early termination.

 

Minor amendments and legally mandated changes may take effect immediately without prior notice.

17. COMPLAINTS

 

Complaints may be submitted to hello@equi-haven.com. We aim to respond within a reasonable timeframe.

 

 

18. GOVERNING LAW AND JURISDICTION

 

These Terms are governed by Dutch law. Any disputes will be exclusively resolved in the Netherlands.
